1. Acceptance of Terms

By accessing and using AdClinica's software and services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

AdClinica provides marketing intelligence and content services for behavioral and mental health practices. Our services include but are not limited to social media management, reputation management, website optimization, and industry and competitive intelligence. AdClinica is a marketing service and does not provide medical advice.

3. User Responsibilities

Users are responsible for:

• Maintaining the confidentiality of their account credentials
• Ensuring that content they approve for publication complies with the advertising, licensing and healthcare regulations that apply to their practice
• Using the software in accordance with its intended purpose
• Not submitting patient information to the service
• Reporting any security vulnerabilities or issues promptly

4. Data Security and Privacy

AdClinica is committed to protecting user data. We implement industry-standard security measures to protect sensitive information and ensure data integrity throughout our systems. AdClinica is not designed to receive protected health information.

5. Software License

Subject to these Terms of Service, AdClinica grants you a limited, non-exclusive, non-transferable license to use our software and services for your practice's marketing operations. This license is contingent upon your compliance with all terms and conditions outlined herein.

6. Service Availability

While we strive to maintain continuous service availability, AdClinica does not guarantee uninterrupted access to our software and services. Scheduled maintenance and unexpected technical issues may temporarily affect service availability.

7. Limitation of Liability

AdClinica shall not be liable for any indirect, incidental, special, or consequential damages resulting from the use or inability to use our software and services, even if we have been advised of the possibility of such damages.

8. Termination

Either party may terminate this agreement at any time with proper notice. Upon termination, access to AdClinica software and services will be discontinued, and any outstanding obligations must be fulfilled.

9. Updates to Terms

AdClinica reserves the right to modify these terms at any time. Users will be notified of significant changes, and continued use of our services constitutes acceptance of the updated terms.

10. Acceptable Use and Anti-Spam

AdClinica sends cold LinkedIn and email outreach on your behalf to business contacts. You are responsible for the lawfulness of that outreach and for the consent on which it relies:

• You confirm you have a lawful basis to contact the people in your outreach audiences, and that they are business contacts rather than consumers where the law distinguishes the two.
• You will honour every opt-out, unsubscribe and do-not-contact request promptly, and will not use the service to send to anyone who has asked you to stop.
• You will comply with the anti-spam, advertising, telemarketing, data-protection and platform rules that apply to your outreach and your jurisdiction (for example CAN-SPAM, CASL and GDPR/PECR, and LinkedIn's own terms).
• You will not use the service to send unlawful, deceptive, harassing or impersonating messages, or to contact people who have opted out.

We may throttle, suspend or refuse any send, campaign or account that we reasonably believe breaches these terms, and we may stop a client's sending at any time to protect the deliverability and reputation of the shared platform.

AdClinica processes business contact data only. It is not designed to receive patient or other protected health information, and no clinical data may be uploaded to or sent through the service.
